1. They’re Generalists, Not Specialists

If your lawyer is juggling multiple areas of law, they simply can’t focus on the sophisticated nuances of personal injury laws. You need someone who handles personal injury cases day in and day out because that experience translates to better outcomes.

2. They Don’t Have Good Systems in Place

Another reason many personal injury lawyers fail their clients is due to poor systems. What does that mean? Simply put, they don’t have a reliable process to ensure that each case progresses toward a successful resolution.

A good personal injury lawyer has thought through every phase of your case: from pre-litigation to discovery, and eventually, trial preparation.

Without a well-organized system, cases drag on unnecessarily, documents get lost, and important deadlines are missed. If your lawyer doesn’t have clear timelines and processes in place, you’ll likely be left wondering why your case is taking so long to resolve.

3. They Lack Adequate Staff

In many rural areas, some lawyers don’t have enough staff to effectively manage their caseloads. This results in lawyers doing everything themselves—paralegal work, legal assistant tasks, and all the big-picture thinking that should be their main focus.

For example, new laws allow you to settle with a liability carrier while still pursuing an underinsured motorist claim. However, if a lawyer doesn’t follow the specific requirements of the law, you could lose out on potentially hundreds of thousands of dollars.

Before you hire a lawyer, ask them how they stay up to date on changes in the law. This will give you a sense of how knowledgeable and current they are in their practice.
