Pressure Ulcer and Nursing Home Accountability: What Families Should Know

When a loved one moves into a nursing home, families expect high-quality care. But what happens when care falls short, and preventable injuries like a pressure ulcer occur in a nursing home?

The case of Clements v. Medical Facilities of America highlights the devastating consequences of nursing home neglect. Understanding the risks of pressure ulcers and the legal rights available can empower families to ensure their loved ones receive proper care.

Why a Pressure Ulcer A Problem In A Nursing Home?

A pressure ulcer, also known as a bedsore, develops when prolonged pressure restricts blood flow to the skin. This can happen when a person is immobile for long periods without repositioning. In a nursing home, where many residents have limited mobility, preventing pressure ulcers is crucial. The early stages of these ulcers are treatable, but if neglected, they can become severe, leading to infections, tissue damage, and even death.

The Case of Clements v. Medical Facilities of America

In the Clements case, the plaintiff sued the nursing home for failing to properly care for an elderly resident, Fred Hodnett. During his eight-month stay, Hodnett developed severe pressure ulcers, which ultimately contributed to his death. The nursing home also failed to timely diagnose and treat his Clostridium difficile (C. diff) infection, which further worsened his condition.

From the outset, this case underscores a failure in basic care standards. The court opinion notes, “Hodnett did not have any pressure ulcers when he was initially admitted to the nursing home.”​

His wounds started small but quickly escalated. By the time he was transferred to a hospital, his pressure ulcers had worsened to a stage that required serious medical intervention, including wound debridement and antibiotics.

What Went Wrong?

In a nursing home, staff is required to follow certain standards to prevent conditions like this pressure ulcer. These include regularly turning and repositioning immobile residents, keeping skin clean and dry, and ensuring proper hydration and nutrition. Yet, in the Clements case, these basic measures were ignored.

The nursing home documented that Hodnett’s ulcers spread rapidly, reaching a point where they became “unstageable,” meaning the extent of tissue damage was so severe that it could not be immediately determined​. Despite his condition, staff failed to provide the necessary interventions to prevent further complications.

One of the key failures in this case was the delay in diagnosing Hodnett’s C. diff infection. The court opinion highlights that, despite clear symptoms of the infection, the nursing home did not perform appropriate diagnostic tests until months later.

By that time, the infection had progressed, contributing to sepsis and ultimately, death.

Why Nursing Home Pressure Ulcer Accountability Matters

The Clements case is a clear example of nursing home neglect. When a facility fails to meet the standard of care, it isn’t just an isolated mistake—it’s a failure that can have life-threatening consequences.

Families entrust nursing homes to care for their loved ones. When that trust is broken, the results are devastating. But nursing homes are legally obligated to provide care that meets basic health and safety standards. If they fail, they can and should be held accountable.

As the court notes, “the failure to properly treat Hodnett’s pressure ulcers and timely diagnose his infection fell below the standard of care.” This failure led to a tragic outcome that could have been avoided with proper attention and care.

Monitoring Your Loved for Pressure Ulcers in Nursing Homes

Families often feel powerless when it comes to ensuring that their loved ones receive the best possible care in a nursing home. However, there are steps you can take to protect them.

1. Visit Regularly

Frequent visits help ensure that your loved one is being cared for properly. Pay attention to their physical condition, including their skin. Are there any red, tender spots? Does your loved one complain about pain in areas where they lie or sit frequently? Early signs of pressure ulcers include changes in skin color or texture.

2. Ask About Repositioning

Make sure the staff is following proper repositioning schedules. According to medical guidelines, immobile patients should be repositioned every two hours while in bed and more frequently if sitting in a chair. This is a critical step in preventing pressure ulcers from forming.

3. Monitor Hydration and Nutrition

Good nutrition and hydration play a significant role in preventing bedsores. Talk to the staff about your loved one’s diet. Are they receiving balanced meals? Are they drinking enough water? Malnutrition and dehydration are common in nursing home neglect cases.

4. Check Medical Records

Review your loved one’s medical records regularly. This will help you keep track of their care plan, medications, and any new diagnoses. Make sure the nursing home is accurately documenting any health concerns.

5. Communicate with Medical Staff

Don’t hesitate to ask questions. If your loved one develops pressure ulcers, inquire about the treatment plan. How often will the wounds be cleaned and dressed? What steps will the staff take to prevent further sores from forming? Nursing homes should have clear protocols for treating pressure ulcers, and staff should be transparent about how they are addressing these issues.

If you suspect your loved one is suffering from neglect in a nursing home, it’s essential to take action quickly. In cases like Clements, where nursing homes fail to meet basic care standards, legal recourse can hold them accountable.
