4 Signs You Should Hire a Personal Injury Attorney in Virginia

21 Nov 2025

Getting into a car accident turns your life upside down fast. One minute you’re driving home, and the next you’re dealing with pain, insurance calls, and a vehicle that might not even be drivable. In the midst of it all you may find yourself asking, “Do I need a personal injury attorney after a car accident?”

Truthfully, not every situation requires an attorney. We’ve told plenty of people that they could handle the claim on their own. But there are other times when having a lawyer early makes all the difference in the outcome of your case. Knowing the difference can protect your health, your rights, and your financial recovery.

Below are four key signs that you should seriously consider hiring a personal injury attorney after an accident in Virginia. You can also watch our Youtube video “4 Signs You Should Hire a Personal Injury Attorney in Virginia“. In the video I share some stories on why being aware of these signs is so important.

1. You’re Experiencing Pain or Injury After the Crash

This one seems obvious, but it’s often overlooked. Many people walk away from an accident feeling “okay” because adrenaline is masking the pain. Sometimes symptoms don’t show up until later that evening or even the next morning.

Symptoms that develop are often:

  • Stiffness
  • Headaches
  • Back or neck pain
  • Tingling or numbness
  • Injuries to the shoulder or knees

Once you feel symptoms and start seeking medical care, the situation changes. Doctors need time to determine what’s actually going on, and sometimes the real injury doesn’t show up until you try physical therapy, chiropractic care, or an MRI.

Meanwhile, the insurance company already has attorneys on standby whose job is to limit their liability.

That’s why—if you’re hurt—getting legal advice early is one of the smartest things you can do. It keeps you from making mistakes that could weaken your claim later.

2. The Insurance Company Tries to Settle Before You’re Done Treating

This happens more often than you’d think. You may be halfway through treatment when the adjuster calls with “good news”:

“We can go ahead and wrap this up for you. We’ll offer $1,000 and pay for your treatment so far, plus a couple more months of treatment.”

Sound tempting, doesn’t it? You might even be unsure how serious your injury is. But early settlement offers are usually designed to cut off their responsibility before the full picture is known.

The biggest problem is what happens after those two months are up. What if you’re still in pain? What if your doctor recommends more treatment. In some cases, your doctor may even find discover something more serious.

We’ve seen countless cases where someone accepted a quick offer and later discovered a more significant injury. By that point, the insurance company is off the hook.

The person injured? Well now they’re on their own paying for those bills, dealing with untreated pain, and with no support for future problems that may come out of that injury.

If an adjuster is pushing you to settle before you’re healed, it’s a sign you should talk to an attorney immediately.

3. More Than One Person Was Hurt in the Accident

Accidents involving multiple people get complicated VERY fast, especially when several claims are pulling from the same policy limits. If there are three or four injured people and only one at-fault driver, there’s a good chance the insurance money won’t stretch far enough on its own.

We’ve seen situations where someone with a minor injury ends up with more compensation than someone who was seriously hurt. This is simply because they didn’t have a lawyer looking out for their best interests.

An attorney can help by:

  • Sorting out all available insurance policies
  • Making sure the insurance company handles claims in good faith
  • Avoiding conflicts between injured parties
  • Protecting the most seriously injured person from getting shortchanged

There’s another important point: if you and another injured person hire the same lawyer, and coverage is limited, that lawyer may have a conflict of interest. In many cases, each person needs separate representation to make sure their case is handled fairly.

If multiple people were injured, it’s smart to get your own attorney sooner rather than later.

4. A Commercial Vehicle Was Involved in the Car Accident

Crashes with commercial trucks or company vehicles are an entirely different world. Large companies and insurers respond quickly—sometimes within hours of the accident. They send investigators to the scene, gather evidence, and start building their defense immediately.

They’re often looking for anything that could help them deny or minimize your claim.

Commercial vehicle cases often involve:

  • Maintenance and inspection records
  • Dash cam footage
  • GPS data
  • Driver logs
  • Company safety policies

These cases can get complicated fast. If you’re hit by a commercial driver, you need someone who knows how to preserve evidence before it disappears and how to hold the company accountable.

Waiting too long can mean losing critical information that could’ve strengthened your case.

Final Thoughts: When You’re Unsure, Talk to a Lawyer

If you’re dealing with any of the situations above, don’t try to navigate it alone. You don’t have to hire a personal injury attorney immediately after a car accident, but a conversation with one can help you understand what you’re dealing with and consequently what could happen if you try to go it alone.

Your health and your financial recovery are too important to leave to chance.
